1. Acceptance of Terms
By accessing, registering for or using ethercam (the "Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any of these conditions, you may not use the Platform. Continued use of the Platform after the publication of modifications constitutes acceptance of such modifications.
2. Description of Service
ethercam provides live streaming, cloud recording and associated streaming server services. We reserve the right to modify, suspend or discontinue, in whole or in part, the Service or any of its features, with or without notice, and to introduce, remove or change features, pricing or usage limits at any time. The Platform is provided "as is" and "as available", without warranties of any kind, express or implied.
3. Accounts and Credentials
You are responsible for maintaining the confidentiality of your access credentials, streaming keys and for all activity occurring under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate any account that we determine, in our sole discretion, has been used fraudulently, abusively or in violation of these Terms.
4. User Content
You retain ownership of all content you stream, record or upload to the Platform. By doing so, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, process, store and transmit such content solely for the purpose of providing you the Service. You represent and warrant that you own all rights to your content or have the necessary authorizations, and that your content does not infringe third-party rights or applicable law.
5. Acceptable Use
It is expressly prohibited to use the Platform to: (i) engage in any illegal or fraudulent activity; (ii) stream or store content that infringes intellectual property, privacy or any other third-party rights; (iii) stream harmful, violent or non-consensual explicit content, or content that constitutes harassment; (iv) attempt to circumvent Service limits, security measures or access controls; (v) perform scraping, data mining or unauthorized automated use; (vi) interfere with the operation of the Platform or other users' servers. Breach of this clause entitles ethercam to immediately suspend or terminate your account, without prejudice to other available legal actions.
6. Payments, Billing and Refunds
Paid plans are billed on a recurring basis according to the plan subscribed (monthly or yearly) through our payment processor Stripe. You authorize the recurring charge to the payment method provided. Prices may be modified with reasonable prior notice; the modification will not affect an already paid period. Refunds are governed by our Refund Policy. Non-payment or the use of fraudulent payment methods may result in immediate suspension of the Service.
7. Termination and Suspension
You may cancel your subscription at any time, effective at the end of the current billing period. ethercam may suspend or terminate your access to the Platform, with or without notice, if (i) you breach these Terms, (ii) your conduct poses a risk to the Platform, other users or third parties, (iii) required by law, or (iv) we cease providing the Service. Upon termination, your right of access ceases immediately; you may export your data during the period indicated in our Refund Policy.
8. Intellectual Property
The Platform, including its software, design, brand, logos, text and other elements, is owned by ethercam or its licensors and is protected by intellectual and industrial property laws. Except as expressly permitted, reproduction, distribution, modification or exploitation of any element of the Platform without prior written authorization is prohibited. No implied rights to the Platform or its trademarks are granted.
9. Disclaimer of Warranties
The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that results obtained through its use will be accurate or reliable. You assume all risks arising from the use of the Platform.
10. Limitation of Liability
To the maximum extent permitted by law, ethercam, its officers, employees and agents shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, revenue or goodwill, arising from the use or inability to use the Platform. ethercam's total liability for any claim relating to the Service shall be limited, in the aggregate, to the amount actually paid by you during the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend and hold harmless ethercam, its affiliates, officers, employees and agents from any claim, damage, liability, cost or expense (including reasonable attorneys' fees) arising from: (i) your use of the Platform; (ii) the content you stream or store; (iii) your breach of these Terms; or (iv) the violation of third-party rights.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with Spanish law, without prejudice to mandatory rules of the user's country of residence. For any dispute arising from these Terms, the parties submit to the Courts and Tribunals of the city where ethercam has its registered office, unless applicable law establishes a different mandatory jurisdiction.
13. Changes
We may update these Terms periodically. The current version will be published on this page with its last updated date. Material changes will be notified through our usual channels (email or notice on the Platform). Continued use of the Service after the changes take effect implies acceptance.
