1. Compliance
ethercam respects the intellectual property rights of third parties and requires its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and applicable European and Spanish law, we will respond to clear and verifiable infringement notices by removing or blocking access to infringing content and, where appropriate, terminating the accounts of repeat infringers.
2. How to File a Notice
If you believe your copyrighted work has been reproduced or streamed on the Platform without authorization, send us a written notice with: (i) identification of the protected work; (ii) identification of the infringing material and the URL or link where it is located; (iii) your contact details (name, email, address); (iv) a good faith statement that the use is not authorized; (v) a statement, under penalty of perjury, that the information is accurate and that you are the owner or are authorized; and (vi) your physical or electronic signature.
3. Designated Agent
DMCA notices should be directed to our designated agent: ethercam — Attn: DMCA Agent — email: support@ethercam.com. We will respond to valid notices within a reasonable time, typically within 2-5 business days.
4. Repeat Infringers
We will apply a "three strikes" policy: after receiving valid and repeated notices against the same account, it may be permanently suspended or terminated, and its associated streaming server blocked, without prejudice to applicable legal actions.
5. Counter-Notification
If you believe your content was removed by mistake or misidentification, you may send a counter-notification with: (i) identification of the removed material and its prior location; (ii) a statement under penalty of perjury that the material was removed by mistake or misidentification; (iii) your contact details; (iv) consent to the jurisdiction of the courts of your district or our headquarters; and (v) your signature. We will evaluate the counter-notification and, if appropriate, restore the content.
6. Abusive or Fraudulent Notices
Submitting false, fraudulent or abusive notices may result in legal liability for damages (including attorneys' fees) under the DMCA and applicable law. We reserve the right to claim such damages and to take appropriate action against anyone who abuses the notice system.
